Who we are
Level Up Media Group LLC (“Level Up Media Group,” “we,” “us,” or “our”) is a Florida limited liability company that provides investor engagement, investor relations, communications, and consulting services to public and private companies. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit levelupm.com (the “Site”), contact us, or interact with us in connection with our services.
If you have questions about this policy, email us at contact@levelupm.com.
What this policy covers
This policy applies to personal information we handle through the Site, through email and other communications with us, and in the course of business relationships with clients, prospective clients, vendors, and partners.
It does not apply to third-party websites, platforms, or services that we link to or use to publish content, such as social networks, newsletters, video platforms, or newswire services. Those services have their own privacy policies.
When we process personal information on behalf of a client under a written agreement, that agreement governs our handling of the information, and the client’s own privacy notice applies to the individuals concerned.
Information we collect
Information you give us
- Contact details: your name, email address, company, job title, and phone number if you choose to share it.
- Inquiry details: your company’s ticker and exchange, its stage, the services you’re interested in, and anything you write in your message.
- Business relationship information: contract, billing, and correspondence records for clients, vendors, and partners.
How the contact form works
The contact form on the Site does not send your information to our servers. When you select the button, the form prepares an email in your own email app, addressed to us. Nothing is sent until you press send in that app. We receive the information only if you send the email, and it is then handled like any other email we receive.
Information collected automatically
Like most websites, the Site is delivered through a hosting and content delivery provider (currently Cloudflare). When you visit, that provider automatically processes technical information needed to deliver the Site and protect it from abuse, such as your IP address, browser type, device type, the pages requested, referring URL, and the date and time of the request. We may also view aggregated, privacy-focused traffic statistics that do not use cookies or identify individual visitors.
We do not use advertising pixels, cross-site tracking, session recording, or fingerprinting on the Site.
Cookies
The Site itself does not set cookies. Our hosting provider may set strictly necessary security cookies, for example to tell people from automated bots or to remember that a browser passed a security check. See our Cookie Policy for details.
Information from other sources
We may collect business contact information from public sources, such as company websites, SEC and SEDAR+ filings, press releases, and professional networking profiles, and from referrals, when we research companies we may work with.
How we use information
We use personal information to:
- respond to inquiries, schedule calls, and prepare proposals;
- provide, manage, and improve our services and the Site;
- communicate with clients, vendors, and partners about engagements;
- send business communications you have asked for or that relate to an existing relationship, with an easy way to opt out;
- maintain records needed for compliance, including disclosure, compensation, and publication records related to investor awareness work;
- protect the Site, our business, and others against security threats, fraud, and abuse; and
- comply with legal obligations and respond to lawful requests from authorities.
We do not use personal information for automated decision-making that produces legal or similarly significant effects.
Legal bases for processing (EEA and UK visitors)
If data protection laws in the European Economic Area or United Kingdom apply to you, we rely on these legal bases: performance of a contract or steps taken at your request before entering one; our legitimate interests in operating and promoting our business, responding to inquiries, and securing the Site, balanced against your rights; compliance with legal obligations; and your consent where we ask for it. You may withdraw consent at any time without affecting earlier processing.
How we share information
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share personal information only as follows:
- Service providers that host the Site, provide email and document tools, or otherwise support our operations, under obligations to protect the information and use it only to provide their services.
- Professional advisers such as lawyers, accountants, and auditors, under confidentiality obligations.
- Clients and their advisers, when sharing is needed to deliver services you are involved in, for example coordinating with a client’s counsel.
- Legal and safety reasons, when we believe in good faith that disclosure is required by law, subpoena, or regulatory request, or is needed to protect rights, property, or safety.
- Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
- With your consent or at your direction.
How long we keep information
We keep personal information only as long as needed for the purposes described in this policy. Inquiries that don’t lead to an engagement are kept only as long as reasonably needed to follow up, and then deleted. Client and engagement records, including disclosure and publication records, are kept for as long as the relationship lasts and afterward for the period needed to meet legal, tax, accounting, and regulatory obligations or to resolve disputes. Hosting logs are kept by our hosting provider under its own retention schedule.
How we protect information
We use reasonable administrative, technical, and physical safeguards appropriate to the information we hold, including encrypted connections (HTTPS) for the Site, access controls, and limiting access to people who need it. No method of transmission or storage is completely secure, so we can’t guarantee absolute security. Email is not always encrypted end to end, so please don’t send sensitive personal information, such as government ID or financial account numbers, by email or through the contact form.
Your privacy rights and choices
Depending on where you live, you may have the right to:
- know what personal information we hold about you and receive a copy;
- correct inaccurate information;
- delete information, subject to legal exceptions;
- object to or restrict certain processing;
- receive your information in a portable format;
- opt out of marketing communications, the sale of personal information, targeted advertising, and certain profiling (we don’t sell personal information or use it for targeted advertising); and
- appeal our decision on your request.
To make a request, email contact@levelupm.com with the subject line “Privacy request.” We will verify your request using information you have already provided, and we will respond within the time required by applicable law, generally within 45 days. You may use an authorized agent where the law allows; we may ask the agent for proof of authorization. We will not discriminate against you for exercising your rights. If we deny your request, you may appeal by replying to our decision; if you are not satisfied with the outcome of an appeal, you may contact your state attorney general or local data protection authority.
California residents
In the past 12 months we have collected the categories of personal information described above: identifiers and contact details, professional or employment-related information, internet or network activity processed by our hosting provider, and the contents of communications you send us. We collect them from the sources and use them for the purposes described in this policy, and we disclose them only to the categories of recipients listed in “How we share information.” We have not sold or shared personal information as those terms are defined under California law, and we do not knowingly sell or share the personal information of consumers under 16. We do not use sensitive personal information for purposes that require a right to limit. California Civil Code section 1798.83 (“Shine the Light”) requests may be sent to contact@levelupm.com.
Marketing emails
Every marketing email we send includes a way to unsubscribe. You can also email contact@levelupm.com to opt out. We may still send you messages about an existing business relationship.
Do Not Track and Global Privacy Control
The Site does not track visitors across third-party websites, so it treats all visitors the same whether or not a Do Not Track signal is sent. We honor Global Privacy Control (GPC) signals as a request to opt out of the sale or sharing of personal information for the browser sending the signal. Because we don’t sell or share personal information, no further action is needed.
International visitors
We are based in the United States, and the Site is hosted on a global network. If you contact us from outside the United States, your information will be processed in the United States and other countries where our service providers operate, which may have different data protection laws than your own. Where required, we rely on appropriate safeguards for these transfers.
Children’s privacy
The Site and our services are intended for businesses and adults. They are not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, email us and we will delete it.
Third-party sites and platforms
The Site links to third-party websites, and our work for clients may appear on third-party platforms such as social networks, newsletters, video sites, and newswire services. We don’t control those services, and their privacy practices are governed by their own policies.
Changes to this policy
We may update this policy from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, provide a more prominent notice on the Site. Changes take effect when posted.
